DARWIN, Australia (AP) — A woman was sentenced Friday to three years in jail for masturbating and then ejaculating Viagra while she was in jail for a criminal charges. Her defense attorney, Sarah Linden, said the man, also a pharmacist, had been charged with criminal misuse of prescription drugs. She called the woman's defense plea an attempt to "embarrass her" and said the man had "done all that he wanted" in court.
Prosecutors allege that Linden pleaded no contest to one count of criminal misuse of prescription drugs, one count of using Viagra, and one count of conspiring to sell prescription drugs, which is an illegal drug. She told the jury that "Viagra" was the first prescription drug she had ever sold to a man, and she had sold it to a man, too.
Prosecutors claim that Linden had used prescription drugs that were not approved by the FDA in treating erectile dysfunction, including Viagra. She said the man who sold the drugs was convicted of criminal misuse of prescription drugs, one count of using Viagra, and one count of conspiring to sell prescription drugs, which is an illegal drug. The court found that the Food and Drug Administration has not approved a generic version of the medication and will only be approved for that product, and that the manufacturer is not responsible for the quality of the medication.
The ruling, made following a motion by the drug company to invalidate the FDA’s decision to allow the company to sell a generic version of Viagra.
The decision by the court is one of several that have been overturned by the FDA in recent years.
Under the Food and Drug Administration’s rules, the drug’s maker can legally sell a generic version of Viagra without a prescription. But the company must prove that its drugs are not safe and effective for their intended use.
